Agreement to Terms

By accessing or using FabView Studio, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this application.

Use License

Permission is granted to temporarily access and use FabView Studio for personal or commercial use subject to the following restrictions:

• You must not modify or copy the materials
• You must not use the materials for any commercial purpose without proper licensing
• You must not attempt to decompile or reverse engineer any software contained in FabView Studio
• You must not remove any copyright or other proprietary notations from the materials
• You must not transfer the materials to another person or "mirror" the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by FabView at any time.

User Account

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree not to disclose your password to any third party.

Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of FabView and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of FabView.

User Content

Our service allows you to upload, store, and manage fabric and furniture visualizations. You retain all rights to your content. By uploading content, you grant us a license to:

• Store and process your content to provide the service
• Display your content to you and others you designate
• Make backups of your content for data protection purposes

You are responsible for the content you upload and must ensure you have the necessary rights and permissions to use any materials.

Prohibited Uses

You may not use FabView Studio:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate FabView, a FabView employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the service
• To introduce any viruses, trojan horses, worms, logic bombs, or other malicious material

Service Availability

We strive to provide reliable service, but we do not guarantee that the service will be uninterrupted, timely, secure, or error-free. We reserve the right to modify or discontinue the service at any time without notice.

Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis. FabView makes no warranties, expressed or implied, and hereby disclaims all warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

Limitation of Liability

In no event shall FabView, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which FabView operates, without regard to its conflict of law provisions.
